Terms of Service
These terms govern your use of The Commish ("the app"), operated by Data X You ("we", "us"). By creating an account you agree to them.
What the app is
The Commish is a record-keeping and coordination tool for fantasy sports leagues: dues tracking, league votes, a league rulebook, punishments agreed to by members, and league history. It is a companion to scoring platforms, not a scoring platform, sportsbook, or payment service.
Money: what we never do
The app never holds, transfers, processes, or guarantees money. Dues and payouts in the app are records only, entered and confirmed by your league's commissioner. When the app shows a "pay" button, it only opens a third-party payment app (such as Venmo, Cash App, or PayPal) with details prefilled; the payment happens entirely within that service under its terms. We are not a party to any payment, we cannot reverse or recover payments, and we make no representation that recorded amounts are accurate. Disputes about money are between league members.
The app does not accept or facilitate wagers. League dues and prize records are private arrangements among league members; you are responsible for ensuring your league complies with the laws that apply to you.
Punishments are voluntary
Punishment features (terms, signatures, proof, verdicts) document a social agreement among league members. Signatures in the app are a record of that agreement, not a legally binding contract, and we do not and cannot enforce any real-world conduct. Never agree to, demand, or perform anything dangerous or unlawful. You are solely responsible for what your league agrees to and for your own participation.
Your content and conduct
You keep ownership of content you post. You grant us the license needed to store and display it to your league. You agree not to post content that is unlawful, infringing, or harassing, and not to upload imagery of anyone who has not consented. League members can report content; commissioners can remove content and members. We may remove content or suspend accounts that violate these terms.
League content is controlled day to day by your league's commissioner, including removing members, editing league settings, and deleting the league (which permanently deletes its content).
Accounts
You are responsible for activity on your account. You can delete your account in the app at any time; league history keeps your display name on records you participated in, consistent with the app's permanent-record features.
Disclaimers
The app is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for disputes among league members, including money disputes and punishment disputes. Our total liability for any claim is limited to the greater of $50 or the amount you paid us in the past twelve months.
Termination
You may stop using the app at any time. We may suspend or terminate accounts that violate these terms or abuse the service.
Changes
If these terms change materially, we will update the effective date and announce it in the app. Continued use after changes means you accept them.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict of law rules.
