Terms of Service (EULA)
These terms are the end user license agreement governing your use of The Commish ("the app"), operated by Data X You ("we", "us"). You must agree to them before you create an account or sign in.
What the app is
The Commish is a record-keeping and coordination tool for fantasy sports leagues: dues tracking, league votes, a league rulebook, punishments agreed to by members, and league history. It is a companion to scoring platforms, not a scoring platform, sportsbook, or payment service.
Money: what we never do
The app never holds, transfers, processes, or guarantees money. Dues and payouts in the app are records only, entered and confirmed by your league's commissioner. When the app shows a "pay" button, it only opens a third-party payment app (such as Venmo, Cash App, or PayPal) with details prefilled; the payment happens entirely within that service under its terms. We are not a party to any payment, we cannot reverse or recover payments, and we make no representation that recorded amounts are accurate. Disputes about money are between league members.
The app does not accept or facilitate wagers. League dues and prize records are private arrangements among league members; you are responsible for ensuring your league complies with the laws that apply to you.
Punishments are voluntary
Punishment features (terms, signatures, proof, verdicts) document a social agreement among league members. Signatures in the app are a record of that agreement, not a legally binding contract, and we do not and cannot enforce any real-world conduct. Never agree to, demand, or perform anything dangerous or unlawful. You are solely responsible for what your league agrees to and for your own participation.
Zero tolerance for objectionable content and abusive users
There is no tolerance for objectionable content or abusive behavior in The Commish. The app is built for trash talk between people who chose to be in a league together, and that is where the line sits. The following are never allowed, in feed posts, replies, punishment terms, punishment proof, captions, ballots, league names, team names, or display names:
- slurs and hate speech of any kind, including content attacking people by race, ethnicity, national origin, religion, disability, sex, gender identity, or sexual orientation
- threats of violence, and encouragement of suicide or self-harm
- sexually explicit content, and anything sexualizing a minor
- harassment, stalking, or targeted abuse of another person
- imagery of a person who has not consented to it being posted
- content that is unlawful or infringes someone else's rights
Accounts that post this content are removed. There is no warning system for the categories above and no appeal to a commissioner: we act on it directly.
How we enforce it
- Filtering. Text you submit is screened automatically, on your device and again on our servers. Content carrying a term on our blocklist is refused before it is ever stored, and the list is updated as reports come in.
- Reporting. Every post, reply, and piece of punishment proof can be reported from the app. A report goes privately to your league's commissioner and to us at the same time.
- Blocking. You can block any member from any post, reply, or proof. Their content leaves your feed immediately, across every league you share with them, and stays gone until you unblock them. Blocking also tells us what happened.
- Our response time. We review every report and every block within 24 hours. When a report is upheld we remove the content and suspend the account that posted it. A suspended account cannot post, reply, or submit proof anywhere in the app.
- Commissioners. Separately from us, your league's commissioner can remove any content and any member of their league at any time.
If you believe we suspended you in error, write to henry@dataxyou.com and we will look again.
Your content
You keep ownership of content you post. You grant us the license needed to store and display it to your league, and to review it for the purposes described above.
League content is controlled day to day by your league's commissioner, including removing members, editing league settings, and deleting the league (which permanently deletes its content).
Accounts
You must be at least 13 years old to use the app. You are responsible for activity on your account. You can delete your account in the app at any time; league history keeps your display name on records you participated in, consistent with the app's permanent-record features.
Disclaimers
The app is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for disputes among league members, including money disputes and punishment disputes. Our total liability for any claim is limited to the greater of $50 or the amount you paid us in the past twelve months.
Termination
You may stop using the app at any time. We may suspend or terminate accounts that violate these terms or abuse the service, without notice and at our sole discretion.
Changes
If these terms change materially, we will update the effective date and announce it in the app. Continued use after changes means you accept them.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict of law rules.
